Role Overview: The purpose of this position is to support the agency as an Associate Attorney whose major purpose is to serve as the agency grievance manager.
This person will primarily handle all grievance appeals that come to Central Office from the incarcerated individuals.
This person will manage all incoming mail correspondence related to grievances and write letters that comply will all relevant policies and law.
This individual will rework the grievance policy to comply with both Indiana law, court precedent, research and apply what other states have done well with this program.
Grievances are mandatory per statute and consist of due process rights that must be complied with.
Salary: The salary for this position traditionally starts at $85,020.
00 but may be commensurate with education or work experience.
New attorneys are welcome to apply (0-5 years experience) A Day in the Life: The essential functions of this role are as follows: The essential functions of this role are as follows: Advises and provides legal support to agency staff on various program and legal areas; Will oversee, draft, review, and provide legal advice relating to grievance appeals; Researches, interprets, and provides legal advice in relation to laws, rules, and legal opinions pertaining to agency operations; May draft and review legislation and administrative rules; Utilizes legal resources, dockets, legal files, and official records of relating to legal procedures; May provide legal advice to grievance specialists in the field; Will maintain exceptional records for second level grievance appeals; Will be the liaison for grievance matters with medical staff, facility staff, religious staff, food service staff, etc.
; May be required to utilize litigation skills and experience relating to agency operations; Organizes and manages caseload in the preparation of litigation; May review pleadings, motions, and discovery; Will be responsible for updating all training materials and policies with regard to grievances; May draft appeals, or briefs, or perform legal writing assignments.
Manage the grievance process in DELTA and be the subject matter expert for this case management system; Manage and respond to all grievances, and mail related to grievances and respond in writing to incarcerated individuals.

What You'll Need for Success: The ideal candidate in this role should minimally have A Doctor of Jurisprudence with 0-5 years of legal experience as a practicing attorney; Indiana Bar Admission license in good standing; Demonstrated knowledge and ability to apply relevant statutes, case law, and rules; Ability to effectively communicate both orally and in writing; Ability to successfully utilize a case management system to manage a large volume of cases; Strong legal research, writing, and litigation skills.
Difficulty of Work: As an Attorney you are required to apply laws, court decisions, precedents, and administrative rules that are often ambiguous.
Judgment is needed to make decisions or significant compromises.
In this position, you must ensure decisions avoid error and are not subject to remand on account of (1) failing to address the issues raised by parties, (2) failing to develop the record as required by Indiana Law, (3) failing to adhere to hearing procedures established by law, (4) failing to be based on substantial evidence, (5) being arbitrary or capricious, and/or (6) being contrary to any constitutional, statutory, or legal principle.
